CCAExpress Terms and Conditions of Service
The preceding pages related to the explanations of CCAExpress' services and certain conditions, restrictions and requirements under which those services will be rendered. The following pages include those terms and conditions by reference and contain further general and specific conditions (collectively, the "Terms and Conditions"). These Terms and Conditions are applicable to the transportation of any package, document, envelope or other items by CCAExpress when shipping between points within Canada, or from Canada to various international points. All dollar amounts are in Canadian dollars unless otherwise indicated.
1. Terms Used
Additional charge: refer to an additional CCAExpress service feature, which may have an additional charge associated with it.|
|Chinese public holidays: including Chinese Spring Festival (7-day-holiday, January or February), Labor Day (May 1st-7th) and National Day (Oct 1st-7th). |
|Daily pickup customers: refer to have shipping patterns that are regular and frequent and require a scheduled, regular pickup arrangement with CCAExpress.|
|Day or Days: refers to business days, excluding weekdays and public holidays.|
|Declared Value for Customs: refer to the value of the contents declared by the shipper on international shipments for the assessment of customs, duties and taxes by the destination country.|
|Overnight: refers to next-business-day delivery, excluding weekends and public holidays.|
|Package: refers to any single container (e.g. pak, box) or envelope accepted by CCAExpress for delivery.|
|Prepaid: is when the shipper pays all shipping and accessorial charges.|
|Receiver/Consignee: refers to the person to whom a shipment is being sent.|
|Shipment: refers to one or more packages moving under a single CCAExpress Air Waybill, shipping document or pickup record to one receiver.|
|Shipper/Sender: refers to the person sending the shipment.|
|Transportation charges: refers to shipping or freight charges assessed for the air and surface movement of a shipment, not including any other fees or charges such as Declared Value, additional service fees, or customs duties and taxes.|
2. Commodities Handled and Restrictions upon Service
CCAExpress offers transportation of general commodities subject to the following restrictions:
2.1 Maximum Weight and Size
There is no limit on the number of pieces or the total weight per shipment. However, for each individual package, the following weight and size restrictions apply:
Maximum weight of 66 pounds or 30 kilograms per package
Maximum length of 80 inches or 200 centimetre per package
Maximum total of 120 inches or 300 centimetre for length and girth combined
Length is the longest side of the package or object. Girth is the distance all the way around the package or object at its widest point perpendicular to the length. Irregularly shaped packages or objects are to be treated as if they were in a rectangular box for the purpose of measuring.
2.2 Maximum Declared Value
For international shipments, duties and all applicable taxes may be assessed on the contents of packages. The sender places the declared value for the shipment. Declared value could be the actual or estimated value of the shipment.
According to the China Customs' regulations, there are three basic customs declaration ranges regarding to the different cargo declared value as below:
For the shipment's assess duty lower than 50RMB (converts into approx $8), it is treated as a duty free shipment.|
|For the shipment's assess duty above 50RMB (converts into around $8), it is treated as an express cargo customs declaration which will collect a customs duty and tax based on the China Customs regulations.|
|For the shipment's declared value above 1,000RMB, it is treated as a general cargo customs declaration which will assess a customs duty and tax based on the China Customs regulations. Specific import documentation is required for shipping general cargo to China, including:|

2.3 Prohibited Articles
The following articles are prohibited by CCAExpress. In the event that any such prohibited article enters the CCAExpress system, this does not constitute a waiver on the part of CCAExpress and CCAExpress shall have no liability whatsoever for delay, loss or damage to any such article, even if the shipper has entered a Declared Value on the shipping document.
Articles prohibited by CCAExpress for shipping within Canada and Internationally:
Currency, negotiable instruments (except cheques) and money orders
Any package having a value of more than $50,000
Animal products, non-domesticated
Unset precious stones

2.4 Articles Requiring Pre-approval for shipping within Canada, Internationally or both
Confectionery products such as potato chips in any form, chocolate in any
form, pastries and baked goods in any form
Dangerous Goods (See Section 2.6)
Diagnostic specimens (Biological substances)
Furs (International approval only required)
Gem stones (Prohibited internationally)
Industrial diamonds (Prohibited internationally)
Jewellery shipments in excess of $500
Live animals, birds and insects
Live plants and cut flowers
Seeds (International approval only required)
Unset precious stones (Prohibited internationally)
All articles listed in this section, which may be prohibited all together, require pre-approval to be shipped with CCAExpress. In the event that any such controlled article enters the CCAExpress system, this does not constitute a waiver on the part of CCAExpress and CCAExpress shall have no liability whatsoever for delay, loss or damage to any such article, even if the shipper has entered a Declared Value on the shipping document.
2.5 Personal Effects and Unaccompanied Baggage
These are shipments containing used items intended for personal use rather than items being shipped for distribution, business maintenance, or wholesale/retail sale. Examples of such items are clothing, used cassette tape or CDs, personal grooming items, a suitcase contained within a carton or box, etc.
These items are accepted by CCAExpress for transportation within Canada
Specific export documentation is required for shipping Personal Effects and
Unaccompanied Baggage to China or other international destinations,

- Proof of Status, such as a copy of a passport, visa, air ticket
2.6 Dangerous Goods
Dangerous Goods defined as those materials regulated by the International Civil Aviation Organization (ICAO) and published in the International Air Transport Association (IATA) Dangerous Goods regulations are accepted for transportation only as a pre-arranged, contractual service. 3. Right of Inspection
CCAExpress reserves the right to open and inspect any package tendered to it for transportation, but is not obligated to do so.
CCAExpress reserves the right to reweigh shipments, notwithstanding that a weight has been declared on the shipping document. The corrected weight determined by CCAExpress may be applied for the assessment of rates, and the shipper agrees to pay same.
Reweigh may occur at various transportation points before delivery, therefore reweigh adjustment charges may not be reflected on the same invoice as the original transportation charges.
CCAExpress reserves the right to administer an Additional Handling charge as per Section 8.3, set forth in the CCAExpress Basic Rate at the time of shipping, if the shipper's originally declared shipment weight is less than the shipment weight determined by CCAExpress auditors.
5. Refusal of Packages
CCAExpress reserves the right to reject any package that by reason of the dangerous nature or any other character of its contents is liable, in the judgment of CCAExpress, to soil, taint, or otherwise damage other merchandise or equipment, or that is economically or operationally impractically to transport, or that is improperly packaged or wrapped or labeled.
6. Proper Packaging and Labeling
Considering that CCAExpress operates a high-speed, high-volume, highly automated distribution system, shipper must package their shipment in a manner that properly protects the contents during the transportation.|
|Packages tendered to CCAExpress must be packed or wrapped as to meet the requirements set forth in International Safe Transit Association Procedure 1A.|
|CCAExpress will not be liable for delay, loss or damage to goods caused or contributed to by defects in the packaging used by the shipper.|
| The use of CCAExpress-provided packaging is not a guarantee that an item is sufficiently packaged for transportation.|
Every package tender to CCAExpress must contain complete Shipper and Receiver details including postal code or ZIP code, contact names, telephone numbers and a CCAExpress Tracking Number on the Air Waybill.|
|CCAExpress cannot deliver to a P.O. Box number. Packages require a street address including apartment/suite/unit numbers and the receiver's name and telephone number.|
|A Rural Route number is acceptable if the receiver's full name and telephone number are clearly marked on all packages.|
Charges, set forth in the CCAExpress Basic Rate applicable to the shipment in effect at the time of shipping, will be assessed. Shipper agrees that CCAExpress shall have a lien on the shipment for all freight charges, account receivables and customs duties.
7.1 Multiple-Piece Shipment
All packages covered under a single CCAExpress service are considered a shipment for the purpose of calculating shipping charges.
7.2 Rounding Measurements
Package weights must be rounded up to the next whole pound or kilogram. Package dimensions must be rounded off to the closest whole inch or centimetre.
7.3 Chargeable Weight of a Shipment
Transportation charges are based on the actual weight of the shipment or the dimensional (volumetric) weight of the shipment, whichever is greater.
Actual weight refers to the weight of a package as measured on a scale.
Dimensional weight is calculated to reflect the size and space (the volume) a package occupies in the CCAExpress transportation system. It is based on the current International Air Transport Association (IATA) volumetric standard, which is subject to change without notice. (See CCAExpress Package Shipping Instruction for details of dimensional weight calculation.)
8. Additional Services
8.1 Delivery Confirmation Service
At the time a shipper tenders a package to CCAExpress, the shipper may request Delivery Confirmation Service by indicating Delivery Confirmation in a CCAExpress automated shipping system. Each Delivery Confirmation response will include the date of delivery and either the name of the recipient or the disposition of the package. The shipper may request a Verbal or Printed Confirmation of Delivery in this service. An additional fee, set forth in the CCAExpress Rate applicable to the shipment in effect at the time of shipping, will be assessed for each such response.
8.2 Address Correction
If CCAExpress is unable to deliver any package or shipment because of an incomplete or incorrect address, CCAExpress will make every reasonable effort to secure the correct address. If the correct address is secured, the shipper will be notified of the correction on their delivery service bill. An additional fee, set forth in the CCAExpress Rate applicable to the shipment in effect at the time of shipping, will be assessed to each package within the shipment for this service.
8.3 Additional Handling
An additional Handling fee, set forth in the CCAExpress Rate applicable to the shipment in effect at the time of shipping, if applicable, will be added to the transportation charge for the following:
CCAExpress also reserves the right to assess the Additional Handling charge for any package that requires special handling.
|Any article that is not fully encased in an outside shipping container.|
|Any article that is encased in an outside shipping container made of metal, wood or wrapped in plastic.|
|Fabric rolls that are wrapped in plastic and are 80 inches or 200 centimetres or less in length are exempt from an additional handling charge.|
|Any package that exceeds 80 inches or 200 centimetres in length.|
|Any package with two sides that exceed 30 inches or 76 centimetres in length each.|
|Shipments when the shipper's original declared shipment weight is less than the actual audited shipment weight.|
9. Additional Charges
9.1 Extended Area Surcharge
An additional charge, set forth in the CCAExpress Rate applicable to the shipment in effect at the time of shipping, may be applied to shipments picked up from or delivered to certain extended points that are beyond the normal CCAExpress service area. Call 1-604-279-8695 for details.
9.2 Re-Rating Charge
An additional charge, set forth in the CCAExpress Rate applicable to the shipment in effect at the time of shipping, on those packages that the shipper does not properly rate, and to re-rate packages the shipper fails to rate properly.
9.3 Minimum Rate or Weight Charge
CCAExpress reserves the right to assess a minimum rate or weight per package or per shipment.
10. Return of Undeliverable Packages within Canada and Internationally
10.1 Domestic Undeliverable Package within Canada
Packages or shipments which are sent by the shipper "Prepaid" and which are refused by the consignee, or which cannot be delivered for any other reason, will be promptly returned to the shipper with an additional cost applied. If the returned package is refused by the shipper, or the package cannot otherwise be returned to the shipper, CCAExpress will retain the package for a period of time determined at its sole discretion, but no less than thirty (30) days, and CCAExpress reserves the right to dispose of the package thereafter.
10.2 International Undeliverable Package
Packages refused by the consignee, or that cannot be delivered for any other reason, will be held, and the shipper will be contacted for further instructions. The shipper will be responsible for payment of all other charges, including, but not limited to, forwarding, disposal, or return transportation charges, as well as any duty and tax, if applicable.
11. Provisions for Customs Clearance of International Shipments
11.1 Export Documentation
The shipper must provide the required export documentation for customs clearance, such as commercial invoice. By providing this documentation, the shipper certifies to CCAExpress that all statements and information relating to exportation and importation are true and correct. There are civil and criminal penalties, including the forfeiture and sale of the shipment, which may be imposed for making false or fraudulent statements.
11.2 Agent for Customs Clearance
When a shipment is imported into or exported from Canada, CCAExpress can act as the agent for customs clearance, where allowed by law.
11.3 Charges for Customs Clearance
CCAExpress' Basic Rate includes the Customs Clearance fee for the shipment's declared value below 1,000 RMB or $160 (exclude Category D cargo). For the shipment's declared value over 1,000 RMB, CCAExpress will add a Customs Clearance fee which is $30-$80. Any customs penalties, storage charges, or other expenses incurred as a result of an action by customs, or failure by the shipper or consignee to provide proper documentation or to obtain a required licence or permit. If the consignee does not pay these additional expenses, the shipper is liable for payment.
12. Billing Options
CCAExpress provides a variety of billing options to suit client's needs:
Prepaid: The shipper pays all the shipping charges, including accessorial charges (additional CCAExpress service charges).
Collect: The receiver will pay all the shipping charges, including accessorial charges. Please note that CCAExpress will charge an additional service fee $5 or 5% of the total shipping charges. Only CCAExpress' term account clients can choose this billing option.
Third-party: A third-party will pay all the shipping charges, including accessorial charges. Please note that CCAExpress will charge an additional service fee $5 or 5% of the total shipping charges. Only CCAExpress' term account clients can choose this billing option.
Other: CCAExpress' term account clients choose this option for a monthly bill.
13. Responsibility for Loss or Damage
CCAExpress has the limited liability up to $100 for any loss or damage of a shipment. The maximum liability for each kilo is $20. In connection with a damaged shipment, the shipper must retain the original packaging until an inspection can be completed by CCAExpress or its agent.
14. Limitation of Liability
CCAExpress liability covers the period of time from the acceptance of this shipment to the delivery to the given address. You agree that a third party at the address may sign as an alternative recipient when the named consignee is absent.
CCAExpress Air Waybill is legally used by CCAExpress or our agent and contractors. We are not responsible for any un-authorized use of this Air Waybill.
CCAExpress will not be liable or responsible for the loss or damage to any package, the contents of which shipper are prohibited from shipping, which CCAExpress is not authorized to accept, which CCAExpress states that it will not accept, or which CCAExpress has the right to refuse.
CCAExpress will not pay for a claim for the loss or damage to property unless all applicable transportation charges have been paid.
CCAExpress shall not be liable for, and reserves the right in its sole discretion to deny claims pertaining to a package for which there are no CCAExpress records reflecting that the package was tendered to CCAExpress by the shipper.
CCAExpress will not be responsible for the loss or damage to perishable commodities or commodities requiring protection from the heat or cold, to the extent the loss or damage results from exposure to heat or cold or the perishable nature of the items.
15. Claims Procedure
A claim may be filed by the customer when CCAExpress did not meet its on-time delivery commitment, or for loss of or damage to a shipment. Tracking or tracing a missing package does not mean that a claim has been filed.

Once a claim has been filed, a claim reference number will be issued by CCAExpress.
All claim notifications must include shipment details including address information (From and To), date of shipment, package weight, the CCAExpress tracking number, and a statement of what is being claimed.
Claims must be filed within the following time periods:
For on-time delivery guarantee claims:
Claims must be filed within thirty (30) days from the date of scheduled delivery.
For loss or damage claims:
Claims must be filed within sixty (60) days after the date of delivery. CCAExpress must be notified as soon as possible after discovery of the damage.
16. Interruption of Service
CCAExpress shall not be liable for any interruption of delivery service due to a cause beyond CCAExpress' control, or due to strikes, lockouts, or labor disputes.
17. Sales Tax
All applicable Federal Sales Taxes required by law will be charged on all net freight costs plus any surcharge. Taxable CCAExpress services includes, but not limited to, CCAExpress Domestic Express Service and Local Courier Service.
18. Late Payment and NSF Cheque Charges
18.1 Late Payment Charge
In the event that an invoice is overdue, CCAExpress will apply a late payment charge in the amount of five percent (5%) on the total balance outstanding of that invoice. This charge will appear on your next CCAExpress bill.
18.2 NSF Cheque Charge
In the event that a NSF cheque returned by banks, CCAExpress will apply a NSF cheque charge in the amount of $20 on the total balance outstanding of that invoice. This charge will appear on your next CCAExpress bill.
19. Fuel Surcharge
CCAExpress reserves the right to apply a fuel surcharge on shipments. The surcharge will be applied for such periods as CCAExpress may determine necessary. Call 1-604-279-8695 for details.
20. Security Surcharge
CCAExpress reserves the right to institute a security surcharge on shipment without notice. The surcharge will be applied for such periods as CCAExpress may determine necessary. Call 1-604-279-8695 for details.
21. Future Changes
